View Full Version : NSW: RTA FINES and DEFECTS. DEMERITS INCL. for modifications
move this thread if necessary. didnt know where to post..
after having a quick read of this http://www.rta.nsw.gov.au/cgi-bin/index.cgi?fuseaction=demeritpoints.browsehandler&category=&offence=&SubmitButton.x=75&SubmitButton.y=4
i thought it'd be useful to point out to any body in NSW that is thinking about modyfying your car and pretty much weigh out the benefits of modding.. (i know after i have enough points on my license, i'd be reinstalling some of my mods LOL)
for those that currently have less than 3pts, you might want to fix your car up or else risk loosing your license if getting pulled over according to these rules below..
i found alot of these very surprising and didnt know that demerit pts were involved ! learnt something new and hope this will save some of you guys if you happen to get an asshole of a cop

wow.
some of these rules are gay.
but i think that anything like defective seating, or defective steering more refers to if you replace your seat with a non adr approved seat, and dont get it engineered, or replace your steering wheel with one below 350mm, or if you put a non airbag wheel on your airbag car
and the number plate one doesnt say moved from oem position, it says Use vehicle with obscured/defaced/illegible number plate, so as long as you can see it.
but good post none the less ;)

Hence the reason my whole car and all my mods have been engineered..
Some of those rules are gay but there rules none the less!
does engineering protect the sticking your hand out? haha..

they are maximum penalties.
thats like the maximum penalty for being too low is probably demerit points, but i've never heard of a first offender being done for points unless the thing is scraping on flat ground.
they are not maximum penalties.. a member on this forum got done for defective seatbelt. he had a small fray in his.. 243 + 3pt

having any mods to your car legally engineered does not prevent your car getting pulled over or harassed :(

I see nothing in the guidelines mentioning a particular seat brand or style. So instead of suggesting Bride's & Recaro's which is not conclusive, wouldn't the defect hinge on whether it's reclinable or fixed? just curious
yehh.. it doesnt say anyhting about brides or recaro's. i was just stating some examples that honda' drivers might have
as for hinge or fixed seats, no idea. the title just states "not comply with standard" i guess you can always try tell the officer your bride seats are stock ? hehe

so when you have say DVD HU which can play Video DVD, you CANT turn it on while you in the car... well most of the time you are driving in the car rite? so whats the point of having them? should we replace the OEM BMW 7 series HU because they can play DVD video that you CANT use?

It isnt a hard process to take out of most of them, dunno bout the new beamers though, they'd be tricky.

to have them installed properly, theres a "lock" that is supposed to be attached to your handbrake. once you have the handbrake up, you'll be able to watch it.. ie: when you're parking and waiting for someone or something.. thats the legal method..

Yes thats how it should be done, people look past it because it isnt as noticable as Recaros or Brides, or if you have done a motor swap. A brake upgrade is definatly one of the bigger mods which need to be engineered and letting the RTA know of the change.

alot of it is up to "police discretion"
i got defected for having my car too low, and i gota admit it was dumped!
so i copped a fine, 1 point lost, and i had to raise my car and bring it into a cop shop for inspection.. i raised the car above 10cm and had everything cleared and checked off
3 days later.. got pulled over again bcuz apparently "i didnt have suspension" and got another fine for "driving a vehicle with parts unsafe for the road". another 125 bucks and 3 points.. laters to my lisence for 6 months
on both occassions the police took fotoz of the car so when i went to court the judge looked at me (young dude), looked at the fotoz of my car, n pretty much told me to fcuk off
its bs, but we gota put up with it..

yes. greens have 7. if you loose demerit pts, and happen to go into the negative, then you will be suspended. upon returning from suspension, you will accumulate the points that you lost from this offence
ie: you have 2 pts. speeding will deduct 4pts. you will be suspended for 3months (minimum), and then when you return to driving, you will have 2pts again.
the offence you outlined above im guessing goes for RED P platers that drive turbo cars or driving cars that have restrictions. Or if you drive a vehicle that carries more than 12 passengers

their reasoning behind this is if you get side swiped at the time you have your hand out the window then your hand is gone a cop told me this when i got pulled over once. luckily i proved to him its impossible that my arm was pretruding from the car as i always have my window up just a little bit for this exact reason..

well imagine you have seats that arent adr apprioved. theyere absolutely shitty quality
youre in a crash, and the seat jsut snaps. no suport what so ever, your body is jsut gonna slip out of the seat belt, and get ****ed up
its not jsut the seats, they need to be engineered to ensure the rails are fine. what happens if the rails are ****ed? youre in a crash and the entire seat comes off the floor, and you get sent into the steering wheel/dash/windscreen
its the little details that are important not jsut the big obvious shit
paps02

so recaros arnt adr approved OR they need to be engineer approved so that you are not defected? because some cars come with recaro as stock!!!

if they come with recaros stock theyre obviously gonna be adr approved arent they
but its not just recaros, its ANY AFTERMARKET SEAT. and the installation has to be engineered.

one question... prob not even supposed to be here but,
when you change ur engine obv u have to tell RTA but what else would u have to do??
also... is there a charge for have a different cluster to oem.. say from ek1 to ek9 having differnt kms??
trism
12-10-2008, 06:09 PM
other then getting it engineered if need be, you just need to get a place that does blueslips to sight the engine number, they write something out, you take it into rta, and change engine number
and no, nothing about clusters, exept that technically you should have the kms on teh new one wound to match the old one

I was talking to a guy form the RTA just then and he was explaining to me points on a license... Instead of saying "you have 2 points left" he was saying "you have 5 points and you don't want to hit 7 because that is when you loose your license" (Green P's = Max of 7 Points)...
So is this how the points system works, you start out on zero and loose your license when you accumulate your maximum?

if you want fixed seats you have to register your car as a 2 seater?

I just thought i'd post it up here.
my gfs dad owns a small rigid truck, it is loaded with pallets daily. the side of the truck has been hit with a pallet a few times and has been smashed a bit out, probably around 4cm from the original position (basically been dented from the inside so the side is out 4cm or so from the original position).
He was pulled over, 3 cops looked over the truck and deemed it defective as the side was "dented and extended the width of the overall vechile".
Okay fair enough this is correct. However, on this truck (and most trucks in australia) the side mirros extend past the rear container of the truck a good 30-40cm at LEAST. therefore, how does a 4cm dent in the rear container make the vechile's width...wider?hmmm:confused:

whatever point is the lowest, yes mudflaps do count, unless they are like the big rigs which are designed to flap and deter rocks from behind traffic
On 180sx's cops go for the exhaust at the rear near the diff as if it's lowered its going to be 90-70mm off the ground
If I lowered mine my cat would be the lowest if the front deflection plate was removed, lol

Scrutineers at race events (NSW State Cahmpionships) use a device which is basically a metal ring 100mm in height attached to a long handle. They poke it under your car and if it 'tings' anywhere then you are deemed to be too low. Maybe the HP need one of these as the idea of being pinged arbitrarily (as mentioned above) really sucks!

Current laws already provide that the cars of repeat offenders may be forfeited to the Crown. Usually, those vehicles are sold and the money used to recover storage and collection costs. The new laws will allow certain forfeited vehicles to be released to the RTA for crash testing.
The RTA will use the unique tests to investigate the potential effects of certain modifications on overall crashworthiness and the wrecks of these vehicles will be displayed at education days for young drivers, or at other RTA presentations.
